These Terms and Conditions form the agreement between you (the “Client”) and The Roaming Masai Guide Safaris (the “Company”). Please read them before confirming a booking; payment of a deposit confirms that you have read, understood and accepted them.
1. Booking & Payment Terms
1.1 Securing Your Booking: A booking is considered confirmed only upon receipt of a non-refundable deposit of thirty percent (30%) of the total tour cost, alongside a completed booking form.
1.2 Final Payment: The remaining balance of the tour cost is due no later than sixty (60) days prior to the commencement of your safari. If the booking is made within 60 days of departure, full payment is required immediately.
1.3 Payment arrangements: Payment instructions are issued only with your confirmed booking documentation. Please contact our team before making any payment so we can provide the current authorised method and payment reference.
1.4 Currency: All rates are quoted and payable in United States Dollars (USD) unless otherwise explicitly agreed in writing.
2. Cancellations & Refunds
Any cancellation by a Client must be made in writing via email. The date on which the Company receives the email determines the cancellation charge applicable.
- 60+ days prior to departure: Forfeiture of the 30% deposit.
- 59 to 31 days prior to departure: 50% of the total tour cost is forfeited.
- 30 to 15 days prior to departure: 75% of the total tour cost is forfeited.
- 14 days or less prior to departure (or No-Show): 100% of the total tour cost is forfeited.
Please note that specific luxury lodges, private flights, and permits (such as Gorilla or Chimpanzee trekking, and Kilimanjaro park fees) may carry their own strict 100% non-refundable cancellation policies from the moment of booking. These will be clearly communicated during the proposal stage.
3. Alterations to the Itinerary
3.1 Changes by the Client: If you wish to make changes to your confirmed itinerary, we will do our utmost to accommodate them. However, changes are subject to availability and may incur administrative fees or additional costs from lodges and airlines.
3.2 Changes by the Company: The Roaming Masai Guide Safaris reserves the right to alter itineraries, accommodation, or transport if strictly necessary due to circumstances beyond our control (e.g., impassable roads, extreme weather, overbooking by a lodge). In such cases, we will provide an alternative of comparable or superior standard.
4. Travel Insurance Requirements
Comprehensive travel insurance is mandatory for all clients travelling with The Roaming Masai Guide Safaris. Your policy must comprehensively cover:
- Medical expenses and emergency medical evacuation (including Flying Doctors coverage).
- Repatriation to your home country.
- Trip cancellation and curtailment.
- Loss of baggage, personal effects, and money.
The Company assumes no liability for medical emergencies, evacuation costs, or financial losses incurred due to trip cancellation by the Client.
5. Health, Passports, and Visas
5.1 Health & Fitness: It is the Client’s responsibility to ensure they are medically fit to undertake the safari or trek. Clients undertaking Mount Kilimanjaro treks must seek medical clearance from their physician.
5.2 Travel Documents: Clients must possess a passport valid for at least six (6) months beyond their intended departure date from Tanzania, with at least two blank pages. Securing the necessary Tanzanian e-Visa is the sole responsibility of the Client.
5.3 Vaccinations: Clients must consult a medical professional regarding necessary vaccinations (e.g., Yellow Fever, Malaria prophylaxis) required for entry into Tanzania.
6. Liability & Assumption of Risk
6.1 Inherent Risks: Safaris and mountain treks involve travel in remote regions, in close proximity to wild animals, and often on rough terrain. By booking, you acknowledge and accept the inherent risks associated with such travel.
6.2 Company Liability: The Roaming Masai Guide Safaris, its directors, employees, and agents shall not be held liable for any injury, illness, death, loss, or damage to property arising during the tour, except where such loss is caused by the gross negligence of the Company.
6.3 Third-Party Suppliers: We act as an agent for hotels, airlines, and transport companies. We shall not be liable for any delays, losses, or accidents caused by these third-party suppliers.
7. Force Majeure
The Company cannot accept liability or pay compensation if the performance of our contractual obligations is prevented or affected by "Force Majeure". These events include, but are not limited to, war, threat of war, civil strife, terrorist activity, natural or nuclear disaster, epidemics, pandemics, adverse weather conditions, government actions, and all similar events outside our control.
8. Governing Law & Dispute Resolution
These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Republic of Tanzania. Any dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Tanzania.
